1. Equipment Rental Agreement
By submitting a rental booking, the Customer ("You") agrees to rent portable internet equipment ("Equipment") from The IT Experience ("Provider," "We") for the period and at the rates specified in the confirmed booking. This agreement becomes binding upon booking confirmation and payment of the security deposit.
2. Equipment & Service Description
Each rental kit includes a portable internet device, integrated Wi-Fi router, cables, power adapter, and mounting hardware. The Provider will deliver, professionally install, configure, and later retrieve the Equipment. Internet service is delivered via advanced wireless technology. Typical speeds range from 50–200+ Mbps download; speeds are not guaranteed and may vary due to weather, obstructions, network congestion, or service availability. This is a best-effort service, not an SLA-backed connection.
3. Pricing & Payment
Pricing is as published on the Provider's website at the time of booking. The estimated total displayed during booking is an estimate; the final invoice may be adjusted for actual rental duration, add-ons, and applicable surcharges. Payment for the rental period is due in full before equipment delivery. All prices are in U.S. dollars and do not include applicable sales tax.
4. Security Deposit
A refundable security deposit of $399 is required before equipment deployment. The deposit will be refunded once the Equipment has been picked up and its condition and functionality have been validated by the Provider. Refunds are normally processed within two (2) business days of pickup. Deductions may be applied for: late return fees, equipment damage beyond normal wear and tear, missing components, or unreturned equipment. If Equipment is not returned within ten (10) days of the scheduled pickup date without arrangement, the full replacement cost will be deducted from the deposit, and any balance owed will be invoiced separately.
5. Rental Period & Minimum
All rentals have a three (3) day minimum. The rental period begins on the date of equipment delivery and installation, and ends on the scheduled pickup date. Extensions may be requested and will be billed at the applicable daily rate for the total rental duration. Early returns do not qualify for prorated refunds.
6. Cancellation Policy
- 72+ hours before delivery: Full refund of all payments.
- 24–72 hours before delivery: 50% refund of rental fees (deposit fully refunded).
- Under 24 hours / no-show: No refund of rental fees. Deposit refunded upon cancellation.
Emergency dispatch bookings are non-refundable once a technician has been dispatched.
7. Equipment Care & Use
You agree to: (a) use the Equipment only for lawful purposes; (b) not tamper with, open, modify, or attempt to repair the Equipment; (c) protect the Equipment from theft, vandalism, and intentional damage; (d) not relocate the Equipment from the installed location without Provider authorization; (e) ensure the Equipment has access to a standard electrical outlet and a clear view of the sky. The Equipment is designed for all-weather outdoor use; however, the power supply must be protected from direct rain exposure.
8. Loss, Theft, or Damage
You are responsible for the Equipment from delivery through pickup. In the event of loss, theft, or damage beyond normal wear and tear, You will be charged the full replacement cost of the Equipment (currently $399), which may be deducted from the security deposit. You must notify the Provider immediately upon discovery of any loss, theft, or damage. Normal wear includes minor surface scuffs, dust, and cosmetic marks from standard outdoor use.
9. Equipment Protection Plan
An optional Equipment Protection Plan is available for $15/day. This plan waives the first $300 in accidental damage charges (excluding loss, theft, intentional damage, or gross negligence). The Protection Plan does not cover loss of or theft of the Equipment, cosmetic damage that does not affect functionality, or damage caused by misuse, submersion, or unauthorized modification.
10. Late Returns
Equipment not available for pickup at the scheduled time will incur a late fee of $99/day. After three (3) calendar days past the scheduled pickup without contact, the Equipment will be considered unreturned, and the full replacement cost will be charged.
11. Service Level & Limitations
Internet speeds, latency, and availability are provided on a best-effort basis. The Provider does not guarantee minimum speeds, uptime, or uninterrupted service. Performance may be affected by weather conditions, physical obstructions, network congestion, geographic location, and other factors outside the Provider's control. The Provider is not liable for any business interruption, lost revenue, or consequential damages arising from connectivity issues.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE TOTAL RENTAL FEES ACTUALLY PAID BY THE CUSTOMER FOR THE SPECIFIC RENTAL PERIOD IN QUESTION. IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR GOODWILL.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Provider, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Your use of the Equipment, violation of these Terms, or any third-party claim related to Your rental.
14. Force Majeure
Neither party shall be liable for failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, severe weather, network outages, government actions, pandemics, or infrastructure failures.
15. Privacy & Data
The Provider does not monitor, log, or store Your internet traffic or browsing activity. Contact information collected during booking is used solely for rental administration and is subject to the Provider's Privacy Policy.
16. Acceptable Use & Prohibited Activities
You agree to use the internet service provided through the Equipment solely for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations. The following activities are strictly prohibited while using the Provider's internet service:
- Accessing, downloading, distributing, or storing any content that is illegal under federal or state law, including but not limited to child sexual abuse material, pirated copyrighted works, or controlled substance trafficking;
- Engaging in unauthorized access to computer systems, networks, or data (commonly known as "hacking"), including port scanning, vulnerability probing, or deploying malware, ransomware, viruses, or other malicious code;
- Conducting or facilitating fraud, identity theft, phishing, social engineering, or any deceptive scheme;
- Distributing spam, unsolicited bulk communications, or participating in denial-of-service attacks;
- Accessing or distributing obscene material as defined under applicable law;
- Using the service to threaten, harass, stalk, defame, or intimidate any person;
- Operating the connection for illegal gambling, money laundering, or any activity that violates applicable anti-terrorism statutes;
- Circumventing, disabling, or interfering with security features of any website, service, or network;
- Using the service in any manner that could damage, disable, overburden, or impair the Provider's equipment or network.
The Provider reserves the right to immediately terminate service without refund if, in its sole discretion, it determines that the Customer is engaging in any prohibited activity. The Customer acknowledges that the Provider may be required by law to cooperate with law enforcement authorities and may disclose connection records, usage data, and Customer information in response to valid legal process, including subpoenas, court orders, or warrants. The Customer agrees to indemnify and hold harmless the Provider from any claims, damages, fines, or penalties arising from the Customer's violation of this Acceptable Use Policy.
17. Governing Law
This agreement is governed by the laws of the State of New Hampshire. Any disputes shall be resolved in the courts of Hillsborough County, New Hampshire.
18. Entire Agreement
These Terms constitute the entire agreement between You and the Provider regarding the portable internet rental service and supersede all prior agreements or representations. The Provider reserves the right to update these Terms; the version in effect at the time of booking applies to that rental.
